1. Who we are
NurseryRadar (“we”, “us”) is a Florida business. You can reach us at support@nurseryradar.com. These terms apply to nurseryradar.com and our related services (the “Service”). By using the Service, you agree to these terms.
2. What NurseryRadar does
NurseryRadar is a directory and request tool. Buyers (such as landscapers, contractors, installers and other plant buyers) can search plants that nurseries have listed, contact nurseries, and send price requests. Nurseries can list their plants, receive requests and send prices.
We are not a nursery, seller, broker or agent. We don’t take orders or payments for plants, and we don’t guarantee any sale, price, quantity, quality, delivery or plant health.
3. Accounts
- You must be at least 18 and able to enter a contract to create an account.
- Give accurate information and keep it up to date. A nursery account must be created by someone allowed to act for that nursery.
- Keep your password private. You’re responsible for what happens under your account. Tell us right away if you think someone else is using it.
- We review nursery accounts before they appear in search. Approval only means a nursery may list on NurseryRadar. It does not mean we have checked its stock, prices, licenses or quality.
4. Listings and availability
- Nurseries are solely responsible for their listings, photos, prices, quantities and business details, and must keep them accurate.
- Listings show what a nursery posted and when it was last updated. “Listed” or “in stock” does not mean the plants are reserved or still available. Always confirm with the nursery.
- Prices shown are the nursery’s listed prices and may change. Taxes, delivery and other fees are set by the nursery.
- Distances are approximate and based on ZIP code locations.
- Directory listings. Some nursery listings marked “Hasn’t added plants yet” are created from public business information, such as a nursery’s own website or business directories, so buyers can find and call them. These listings show only business contact details and a short description, never stock or prices. The business can claim its listing for free to manage it, or ask us to correct or remove it by writing to support@nurseryradar.com.
5. Price requests and quotes
- A price request is an invitation for nurseries to respond. It is not an order.
- When you send a request to nurseries you pick, those nurseries receive the request and the contact details you entered.
- When you post a request to all nurseries near your job, nearby nurseries see the plants, quantities, sizes, job ZIP code, needed-by date, pickup or delivery preference and your notes. Your name, email and phone are shared only with a nursery whose quote you accept.
- A quote is the nursery’s offer. Accepting a quote on NurseryRadar shares your contact details with that nursery so you can finalize the order. It does not create an order, reserve stock, or charge anyone.
- Any order, payment, delivery, return or dispute is between the buyer and the nursery.
6. Nursery responsibilities
- List only plants you actually offer, with honest sizes, quantities, prices and photos of your own stock (or clearly marked reference images).
- Follow all laws that apply to your business, including plant-industry, licensing, tax and consumer-protection rules.
- Use buyer contact details only to respond to that buyer’s request.
7. Acceptable use
You agree not to:
- post false, misleading, illegal or infringing content;
- send spam, collect other users’ contact details, or use them for anything other than the related request;
- copy or scrape the Service, or use bots to access it, without our written permission;
- upload harmful files or try to break, overload or get around the security of the Service;
- harass anyone or pretend to be someone else.
8. The “Ask for help” assistant
The helper is an automated tool, which may use artificial intelligence, that answers questions and can fill in searches or price requests for you to review. It can make mistakes. It does not see live stock or prices and never sends anything on your behalf. Check its suggestions before you rely on them, and don’t enter sensitive personal information into it. Messages you send to the helper are processed by our AI service provider as described in our Privacy Policy.
9. Fees
- NurseryRadar is free during our launch period.
- We may later offer or require paid plans, for example a monthly fee for nurseries and/or charges based on activity such as visits, clicks, calls or requests.
- We will give you at least 30 days’ notice by email before any fees start, along with the prices and how activity is counted. You won’t be charged unless you agree to a paid plan, and you can close your account before any charges begin.
10. Your content
You keep ownership of the content you add (such as listings, photos and messages). You give us a non-exclusive, royalty-free license to host, copy, display and adapt it as needed to run, improve and promote the Service. You confirm you have the right to share it.
11. Suspension and closing your account
We may suspend or remove listings or accounts that break these terms, receive repeated reports, or put users at risk. You can stop using the Service at any time and ask us to close your account by writing to support@nurseryradar.com.
12. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee that the Service will be uninterrupted or error-free, or that information on it is accurate or complete.
13. Limitation of liability
To the fullest extent allowed by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, or for any dealings between buyers and nurseries. Our total liability for any claim related to the Service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.
14. Indemnity
You agree to defend and hold us harmless from claims arising from your content, your use of the Service, your dealings with other users, or your breaking these terms.
15. Changes to these terms
We may update these terms. If a change is significant, we’ll let you know by email or on the site before it takes effect. Continuing to use the Service after the change means you accept the updated terms.
16. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Florida.
